Notification of violation and terms of use – iProexperts.us
1. Accuracy and Authorization Statement
By submitting a notice of copyright or trademark infringement to iProExperts, you declare that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an allegedly infringed exclusive right.
2. Investigation and Actions
iProExperts undertakes to investigate notices of copyright and trademark violations, taking appropriate actions in accordance with the Digital Millennium Copyright Act (DMCA). Inquiries outside of this procedure may not receive a response.
3. Delays and Accessibility
iProExperts sites and services may be subject to limitations, delays, failures, and other issues inherent to the use of the Internet and electronic communications. iProExperts is not responsible for delays, failures, or damages resulting from these issues.
4. User Feedback
iProExperts appreciates feedback but does not accept unsolicited ideas. Unsolicited submissions become the property of iProExperts with no obligations of confidentiality.
5. Warranties and Disclaimers
iProExperts does not control or have an obligation to act on the access, use, and effects of the Sites and Services. You exempt iProExperts from liability related to content and accept the sites and services “as is.”
6. Indemnification
You agree to indemnify iProExperts against losses, liabilities, and expenses resulting from a violation of these Terms of Use or inaccurate information provided.
7. Limitations of Liability
iProExperts will not be liable for direct, indirect, incidental, special, punitive, or consequential damages resulting from the use of the Sites and Services. The maximum liability will be limited to the equivalent of one month’s affiliate fee.
8. Entire Agreement
These Terms of Use constitute the entire agreement between you and iProExperts, superseding previous agreements. Additional terms may exist with third parties but will not interfere with these Terms of Use.
9. Mutual Arbitration Agreement
Disputes will be resolved through arbitration according to the Federal Arbitration Act. Waiver of Class Action applies, and the law of the State of Indiana governs the contract.
10. Applicable Law
This Agreement is governed by the laws of the State of Indiana.
11. Miscellaneous
Violations of these Terms of Use may result in liquidated damages. If any provision is deemed invalid, the remaining provisions will remain in effect. These Terms of Use cannot be assigned without consent. Users are responsible for compliance with applicable regulations.
